If both partners are Hindu / Sikh / Jain / Buddhist, the Hindu Marriage Act 1955, Section 8 is your fastest, cheapest, and most flexible route. Here's everything you need to know about HMA Section 8 at Tis Hazari Court Delhi.
What Does Section 8 Actually Say?
Section 8 of the Hindu Marriage Act 1955 empowers the State Government to make rules for the registration of marriages. Delhi has done so through the Delhi (Compulsory Registration of Marriage) Order, 2014. Under this:
- A marriage solemnised under Hindu rites must be registered
- Registration can be done at the SDM where the marriage took place OR where either partner resides
- The Form-V Marriage Certificate issued is legal proof of marriage
- Same-day registration is possible if all conditions are met
Who Qualifies for HMA Section 8?
- Both partners by religion are Hindu, Sikh, Jain, or Buddhist (Section 2 definition)
- Groom is 21+, bride is 18+
- Both of sound mind and consenting
- Neither has a living spouse
- Not within prohibited degrees of relationship (unless custom permits)
Why HMA is Faster Than SMA
Under SMA, a 30-day public notice is required before solemnisation. Under HMA Section 8, the marriage is already solemnised by a recognised religious ceremony (Arya Samaj, traditional Hindu, Sikh Anand Karaj, etc.) — the SDM just registers it. No notice period needed. Hence same-day is legally possible.
The Arya Samaj Connection
Arya Samaj weddings are recognised under HMA. The Mandir Marriage Certificate, issued by a registered Arya Samaj Mandir, serves as proof of religious solemnisation. Our Mandir near Tis Hazari is registered with the Delhi government, and our pandit is empanelled — so the Mandir certificate is accepted by SDM Tis Hazari without question.

Common HMA Section 8 Questions
Can a Buddhist and Hindu use HMA?
Yes — Section 2 of HMA defines Hindu to include Buddhists, Jains, and Sikhs.
Can a Hindu and a religious convert (e.g. converted Christian back to Hindu) use HMA?
Yes, with conversion certificate from a registered religious authority.
What if one is a born Hindu but doesn't practice religion?
Religion is determined by birth and not by practice. If your Aadhaar / birth records show Hindu, HMA applies.
Is Anand Karaj (Sikh wedding) accepted under HMA?
Yes. Anand Karaj is a recognised Hindu/Sikh religious ceremony. Anand Karaj certificate + photos work as proof of solemnisation.
Can we skip the religious ceremony and just register under HMA?
No — HMA Section 8 requires a religious ceremony to have occurred. If you don't want a ceremony, use Special Marriage Act instead. Our ₹12,100 includes the Arya Samaj ceremony, so the religious step is taken care of.
