What Does Section 8 Actually Say?
Section 8 of the Hindu Marriage Act 1955 empowers the State Government to make rules for the registration of marriages. Delhi has done so through the Delhi (Compulsory Registration of Marriage) Order, 2014. Under this:
- A marriage solemnised under Hindu rites must be registered
- Registration can be done at the SDM where the marriage took place OR where either partner resides
